AccentLab Terms of Use

1. Acceptance of Terms

Welcome to AccentLab! These Terms of Use ("Terms") govern your use of the AccentLab mobile application ("App") and related services ("Service") provided by Sergei Koniukhovskii ("we," "us," or "our").

By downloading, installing, or using AccentLab, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

AccentLab is an educational mobile application designed to help users improve their British English pronunciation through:

• AI-powered speech analysis and feedback
• Interactive pronunciation exercises
• Progress tracking and personalized recommendations
• Audio examples and practice materials

Educational Purpose: AccentLab is intended for educational and self-improvement purposes. It is not a substitute for professional speech therapy or medical treatment.

3. Subscription Services

3.1 Premium Subscription

AccentLab offers a premium subscription service with enhanced features:

• Premium Monthly: £9.99 per month
• Free Trial: 3-day free trial for new subscribers
• Auto-Renewal: Subscription automatically renews unless cancelled

3.2 Apple In-App Purchases

All subscription purchases are processed through Apple's App Store:

• Payment will be charged to your Apple ID account
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase

3.3 Cancellation and Refunds

• You may cancel your subscription at any time through your Apple ID account settings
• Cancellation takes effect at the end of the current billing period
• Refund requests must be made through Apple's App Store support
• We cannot process refunds directly as all payments are handled by Apple

4. User Accounts and Data

4.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account

4.2 User Content

When using AccentLab, you may provide voice recordings and other content:

• You retain ownership of your voice recordings and personal data
• Voice recordings are processed temporarily for analysis and are not permanently stored
• You grant us a limited license to process your content solely for providing the Service
• You represent that you have the right to provide any content you submit

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• Voice recordings are processed in real-time and not stored permanently
• We use Firebase (Google) for secure data storage and authentication
• We use OpenAI services for speech analysis (data not retained by OpenAI)
• We comply with GDPR, CCPA, and other applicable privacy laws

6. Acceptable Use

You agree not to use AccentLab to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload malicious content or attempt to compromise the Service
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service for any commercial purpose without our written consent
• Share your account credentials with others

7. Intellectual Property

7.1 Our Rights

AccentLab and all related content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use AccentLab for personal, non-commercial purposes in accordance with these Terms.

7.3 Third-Party Content

AccentLab may include content from third parties, including OpenAI-generated content. Such content is subject to the respective third parties' terms and conditions.

8. Third-Party Services

AccentLab integrates with third-party services:

• OpenAI: For speech analysis and content generation
• Firebase (Google): For backend services and data storage
• Apple App Store: For payment processing and app distribution

Your use of these services is subject to their respective terms of service and privacy policies.

9. Disclaimers and Limitations

9.1 Educational Tool Disclaimer

• We strive to maintain high service availability but cannot guarantee uninterrupted access
• The Service may be temporarily unavailable due to maintenance, updates, or technical issues
• We reserve the right to modify or discontinue features with reasonable notice

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

11.1 Termination by You

• You may terminate your account at any time by contacting us
• Upon termination, your access to premium features will end at the current billing period

11.2 Termination by Us

• We may terminate or suspend your account for violation of these Terms
• We may discontinue the Service with 30 days' notice

12. International Use

AccentLab is available internationally, but:

• You are responsible for compliance with local laws
• Some features may not be available in all regions
• Pricing may vary by region as determined by Apple

13. Updates and Changes

• We may update the App and these Terms from time to time
• Material changes will be communicated through the App or email
• Continued use after changes constitutes acceptance of new Terms

14. Governing Law and Disputes

• These Terms are governed by the laws of the jurisdiction where the developer resides
• Any disputes will be resolved through binding arbitration or in courts of competent jurisdiction
• You waive any right to participate in class action lawsuits

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

17. Age Requirements

• You must be at least 13 years old to use AccentLab
• Users under 18 should have parental consent
• We comply with COPPA and other child protection regulations

By using AccentLab, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
